The Ministry of Justice has adopted a refined mechanism for hearing and validating marriage cases involving Saudi citizens and foreign spouses that were concluded without first securing approval from the competent Saudi authorities.
Under the new framework, marriage contracts between Saudis and non-Saudis concluded without the necessary permit will be examined by the Civil Status Courts, in line with the Civil Status Law and the procedures endorsed by the Ministry of Justice.
The move is designed to bolster family stability, resolve related legal and social complications, and ensure the formal registration of such marriages and all associated procedures.
The Ministry stressed that the newly approved procedures are fully consistent with the regulations governing marriages between Saudis and non-Saudis and are intended to regularize undocumented cases while limiting breaches of established rules.
The competent department within the Ministry of Justice will be notified of any application to establish or validate a marriage contract and will liaise with the Ministry of Interior to take whatever action it deems appropriate on the request.
If the Ministry of Interior confirms that the authorized official has approved notarization of the marriage contract, the case will be referred to the competent court for consideration and adjudication in accordance with applicable legal provisions.
If the Interior Ministry confirms that the requisite approval has not been granted, the court will rule the claim inadmissible, and any request to complete the procedures in violation of the regulations will not be accepted.
The Ministry underlined that these arrangements do not affect the hearing of claims related to rights arising from the marriage relationship, whether between the spouses themselves or between either or both spouses and third parties.
This includes claims related to alimony, divorce, inheritance, lineage, and other consequential matters, which will continue to be heard under the new regulations and the applicable legal framework.
